Terms of Service

These Terms govern your use of salengine.io (the "Service"), operated by Immersive Productions Group of Georgia, LLC("we", "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 18 and, if signing up on behalf of an organization, have authority to bind it. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

2. Acceptable use

The Service is intended for permission-based business communication with your own customers, opted-in leads, and existing business contacts. You are solely responsible for ensuring you have a lawful basis and, where required, prior consent to contact each recipient, and for honoring unsubscribe requests promptly.

We reserve the right to investigate suspected violations and to suspend or terminate accounts that misuse the Service.

3. Your content

You retain ownership of contacts, messages, templates, and other data you upload ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to provide the Service. You are responsible for having the rights and lawful basis to process Your Content (including contacting recipients you upload).

4. Our intellectual property

We retain all rights in the Service, including software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

5. Payments, subscriptions, and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms.

Subscriptions renew automatically at the end of each billing period until canceled. New accounts may receive a free trial; if you don't cancel before the trial ends, a paid subscription begins.

6. Service availability

We work hard to keep the Service reliable but do not guarantee uninterrupted or error-free performance. Features may change over time.

7. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time from your account. On termination your right to use the Service ends; you may export Your Content for a reasonable period before it is deleted.

8. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to Paddle for the Service in the twelve months before the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, or loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).

10. Indemnity

You will indemnify us for third-party claims arising from Your Content, your unlawful use of the Service, or your breach of these Terms.

11. Changes to these Terms

We may update these Terms. Material changes will be notified in-app or by email. Continued use after changes take effect means you accept them.

12. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Courts located in Georgia have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
